About

Who we are

Moretto Advocacia focuses mainly on debt recovery. Much of our work takes place at the enforcement stage of court judgments (cumprimento de sentença), when a favorable decision already exists but payment has not yet been made.

Before proposing any measure, we study the case carefully and explain to the client what can be done and what the risks of each option are.

Debt recovery

Winning the case does not always mean getting paid.

Debtors often do not pay and do not disclose their assets. At this stage, the work is to find out, through lawful means, what can be seized and to ask the court for the measures that fit the case.

The path to recovery

  1. 01

Review of the claim and the case

We review the debt instrument, the documents, the deadlines and what has already happened in the case.

  2. 02

    Asset search

We look for information in public registries, open databases and the case records themselves.

  3. 03

    Court measures

We ask the court for the appropriate measures, such as attachment of assets and searches in the Judiciary's systems. The decision rests with the court.

  4. 04

    Follow-up and settlement

We follow the case and assess with you any settlement offer.

What can be searched

  • Real estate
  • Vehicles
  • Bank accounts and investments
  • Equity interests in companies
  • Credits in other lawsuits
  • Machinery and equipment
  • Vessels and aircraft
  • Trademarks and other rights

Not every asset can be seized. A family home, for example, is protected by law, with some exceptions.
